South Africans will soon be able to pursue larger civil claims through the Small Claims Court after the Justice Minister increased the court’s monetary limit from R20,000 to R30,000.
South Africans will soon be able to take larger civil disputes to the Small Claims Court after the Minister of Justice increased the court’s monetary limit from R20,000 to R30,000.
The new determination, published in the Government Gazette on 20 July, replaces the limit that has been in force since 2019 and takes effect on 1 August 2026.
The higher threshold means more disputes can now be resolved through the Small Claims Court, where individuals generally represent themselves without legal representation, making the process quicker and significantly less expensive than ordinary civil litigation.
For consumers, employees, landlords, tenants and small businesses, the increase means a wider range of unpaid debts, damaged property claims, contract disputes and other civil matters may now qualify for the simplified court process.
The Small Claims Court is designed to provide an accessible and affordable way for people to recover money or resolve qualifying civil disputes without the cost and complexity of formal court proceedings. From August, claims of up to R30,000 will be eligible to be heard under this process.
