Review Committee adopt report to amend Section 25 of the Constitution

The Constitutional Review Committee has on Thursday 15 November 2018, adopted a report to amend Section 25 of the Constitution to allow Land Expropriation without compensation.

The motion to change Section 25 was set by the Economic Freedom Fighters’ Floyd Shivambu.

The Democratic Alliance’s Annelie Lotriet offered a different motion, saying the Constitution does not need to be adjusted as there is already provision for land reform.

Twelve votes were in support of Shivambu’s motion, while four voted against the amendment of the Constitution.

The EFF’s recommendation states that Parliament must appoint a mechanism to draft the amendment before the 2019 general elections.

The report will be forwarded to the National Assembly and the National Council of Provinces for consideration.

Ever since President Cyril Ramaphosa’s announcement that the ANC would be spearheading land expropriation earlier this year, there have been mixed emotions by opposition parties.

While the EFF welcomed the idea, parties like the Freedom Front Plus have heavily criticised it.

In March 2018, the FFP launched a plan of action called Fight Back South Africa, to stop expropriation of land without compensation.
